Boote Edgar Esterkin Triumph in High Court Battle

Boote Edgar Esterkin representing Sir David Alliance and his company Anglo Eastern Trust Limited have won a significant victory in a long and hard fought battle against a debtor to Anglo Eastern, following Mr Justice Hart yesterday uphold Sir David''s case. The total award, excluding costs, will be approximately 1.4m.
ELAINE SLATER of Boote Edgar Esterkin representing the clients said that she had always been confident in the final outcome of the case but said that it had been a long and complex battle to overcome the opposition. The parties argued the case in the High Court in London for some 12 days. Paul Chaisty Q.C. and Andrew Latimer were Counsel for the clients
Ultimately Mr Justice Hart concluded that the opposition's account seemed to him to be "inherently improbable". Sir David said yesterday "The defence was to discredit me to the press. The tactic adopted by the family of the defendant failed miserably."
It is interesting to note that trial judge seems to have agreed with Sir David''''s view commenting at one point in his judgment "Sir David''s tax affairs were dealt with with complete honesty". He continued: "Mr Kermanshahchi''s position offers something of a contrast. He has so managed his affairs that despite his UK esidence since 1979 he has never incurred any liability to UK tax."
Richard Slade of Bracher Rawlins and Roy Mathias of Goldkorn Mathias Gentle represented the unsuccessful defendants.
